1. Definitions

 

In this agreement, the following terms have the meanings below:

  • Accidental Damage: Damage caused by a small rock or stone hitting the windscreen while driving on a public highway, street, or road during normal use, resulting in the replacement of the windscreen. Excludes normal wear and tear, theft, misplacement, recklessness, intentional damage, or misuse of the product, vehicle, or windscreen.
  • Commencement Date: The date this warranty is registered on the Lamin8 Website, including submission of the required three photos.
  • Lamin8: Lamin8 Window Film CC (Registration Number: 2008/039218/23).
  • Product: Genuine Lamin8 window film purchased from Lamin8 or an authorised distributor, professionally applied to the Purchaser’s vehicle windscreen by an authorised service provider.
  • Purchaser: The person whose details are registered on the Lamin8 Website against the unique warranty number.
  • Termination Date: The earlier of: six months from the purchase date of this warranty, date of renewal, or date Lamin8 refunds the Purchaser after one event of Accidental Damage.
  • Vehicle: The vehicle registered by the Purchaser on the Website at the Commencement Date.
  • Windscreen: The windscreen installed in the Vehicle at the Commencement Date.

 

2. Scope of Warranty

 

This is a limited warranty in addition to any insurance cover the Purchaser may have. It may cover excess payable under the insurance policy.

The warranty does not apply to commercial, construction, agricultural, emergency, delivery, towing, rental, racing, industrial, or off-road vehicles. It only covers personal-use vehicles on paved public roads at the time of Accidental Damage.

 

3. Registration Requirements

 

To confirm no pre-existing damage and proper product application, the Purchaser must upload the following within one week of warranty issue:

  • Photo of the windscreen.
  • Photo of the vehicle’s licence and registration disc.
  • Proof of payment to the service provider who applied the Product.

If Lamin8 determines the windscreen is damaged, defective, or the Product is improperly applied, the warranty lapses.

 

4. Claims Procedure

 

In the event of Accidental Damage, the Purchaser must:

  • Upload a photo of the windscreen on the same day.
  • Submit a written report via the Website detailing how, where, when, and what caused the damage.

Lamin8 will confirm whether the damage is covered. Lamin8 may inspect the vehicle if necessary. If approved, the Purchaser has three days to upload proof of payment for the replacement windscreen.

Lamin8 will refund up to R 1,000.00 to the bank account provided at registration. The warranty automatically terminates after the claim is processed.

Important: Claims will be refused if the Purchaser fails to provide required details or photos. Warranty is invalid if the Product is removed, altered, or tampered with.

 

5. Ownership & Transfer

 

  • The Purchaser must remain the sole owner of the Vehicle from the Commencement Date to the Termination Date.
  • Rights under this agreement are personal and non-transferable.

 

6. Renewals

 

  • The warranty may be renewed for R 200.00 via the service provider.
  • Renewal requires re-registration on the Website and uploading new photos of the windscreen, licence disc, and proof of payment within one week.
  • Lamin8 may refuse renewal with one-month prior notice.

 

7. Limitations of Liability

 

Lamin8 is not liable for:

  • Special, indirect, consequential, incidental, or exemplary damages.
  • Loss of future business or goodwill.
  • Damage caused by collision, fire, theft, freezing, vandalism, flood, or standard insurable hazards.
  • Defects from modifications beyond manufacturer specifications.

Liability is strictly limited to R 1,000.00.

 

8. Data Processing

 

To administer this agreement, Lamin8 must process the Purchaser’s personal information in compliance with the Protection of Personal Information Act 4 of 2013. The Purchaser consents to this, and Lamin8 will use personal information only as necessary for the agreement.

 

9. Breaches, Indulgences & Waivers

 

  • Lamin8 may recover all costs from the Purchaser for breaches of this agreement, including legal fees and collection costs.
  • Any indulgence by Lamin8 does not waive its rights. Written waivers apply only to the matter stated.
  • No indulgence will prevent Lamin8 from exercising its rights in the future.

 

10. General Provisions

 

  • The Purchaser warrants that all information submitted is true and correct.
  • Changes to these terms are valid only if in writing and signed by both parties.
  • If a term is found unenforceable, it may be severed without affecting the remaining terms. Parties will attempt to amend unlawful terms in good faith.
  • This agreement constitutes the entire agreement between the parties; any other terms, express or implied, are excluded.

 

11. Acceptance

 

By accepting these terms, the Purchaser confirms they have read, understood, and agree to the terms and conditions of this warranty.
